About the Author
Legendary dealmaker James C. Freund is a retired partner of Skadden, Arps (presently of counsel to the firm). During his 30 years of active practice, Mr. Freund’s primary focus was on representing clients in mergers and acquisitions. Since then, his main professional activity has been in the field of dispute resolution, serving as a mediator and, in some cases, an arbitrator of commercial disputes. In addition to 10 books, including Smart Negotiating: How to Make Good Deals in the Real World (Simon & Schuster, 1992) he has written and lectured extensively in the field of mediation. Mr. Freund taught negotiating as an adjunct professor at Fordham University School of Law for many years; served as chairman and participated in numerous professional seminars; and wrote, narrated and dramatized videos on negotiating, lawyering and acquisition topics.
He resides and works in New York City.

The Art of Evaluative Mediation

This book differs from books which focus primarily on facilitative mediation, where the neutral persons try to assist the disputing parties to negotiate with each other. It thoughtfully explores the world of evaluative/directive mediation, where the neutrals openly assess the validity of each side's positions and suggest how their controversies should be settled. Freund, an experienced merger and acquisitions negotiator who has become a highly respected mediator, employs the evaluative style to help business persons resolve what are primarily money-oriented disagreements. In this book, he carefully explores how such mediators behave -- and how disputing parties should interact with such neutrals. This is a thoughtful book which should be read by persons who serve as mediators and by persons who interact with such problem-solvers.

Interesting Approach to Mediation

I am a facilitative mediator who sees mostly domestic disputes: separation, divorce, parental quarrels. Freund has little respect for facilitative mediation and does not go near domestic disputes. His approach more closely resembles arbitration than mediation. Nevertheless, he has several good ideas that just might work for facilitative mediators like me.

Superb guide to evaluative commercial mediation

Outstanding book on a complex subject. Clear, well-written and practical. Very, very readable. Would recommend to anyone who is either thinking about becoming a commercial mediator or is going to be going through a commercial mediation process.
